Dem Rep. Proposes Historic Legislation To Overhaul Federal Laws, Replace Gendered Terms with Gender-Neutral Language

Rep. Julie Brownley, a Democrat from California, is spearheading an initiative to replace gendered terms in federal law with gender-neutral language.

In a recent press release announcing the legislation, Brownley highlighted the discrepancy between the U.S. Supreme Court's ruling in Obergefell v. Hodges, which granted same-sex couples the right to marry, and the existing language in the U.S. Code that fails to fully acknowledge this constitutional right.

The proposed bill, known as the Amend the Code for Marriage Equality Act, aims to remove gendered terms like "husband" and "wife" from federal laws, replacing them with more inclusive terms such as "spouse" or "married person." Brownley argues that this legislation is crucial at a time when the rights of the LGBTQ community are being undermined by both the Supreme Court and certain state legislatures.

According to Brownley, it is imperative for Congress to demonstrate its commitment to equality by passing this bill. The legislation also seeks to replace references to a "husband and wife" with "married couple" or "person who has been, but is no longer, married." Additionally, the bill would eliminate the phrase "one man and one woman," substituting it with "two people as spouses."

This is not the first time that Brownley has introduced this legislation. The Washington Times reports that she has previously attempted to pass the bill in 2021, 2019, and 2017. The bill was originally introduced by former Rep. Lois Capps, a Democrat from California, in 2015, and in 2021, it garnered support from 39 Democrats who co-sponsored the effort.
