A convicted "sexual predator" has been taken back into custody just one day after being released from a lengthy prison sentence, following an alleged overdose incident.

Albert Lee Gardner, 29, had recently completed a nine and a half-year sentence for lewd and lascivious battery involving a victim aged 12-15. However, his freedom was short-lived as he was arrested by authorities on July 8, after his ankle monitor was discovered in a trash can at a convenience store.

The Hernando County Sheriff's Office reported that a probation officer became suspicious when Gardner's GPS tracker remained at the 7-Eleven in Brooksville, Florida, for an unusually long period of time.

According to FOX 35, Gardner was supposed to be under supervised release for five and a half years following his prison term. However, his actions quickly landed him back in custody. Deputies received a call regarding an overdose at an apartment, where they discovered Gardner had consumed an "unknown narcotic," as described by his sister.

Fortunately, he was revived with the administration of Narcan. Once he was cleared at a hospital, Gardner was immediately booked without bond. He now faces charges of violating his probation and tampering with an electronic monitoring device.
