Former Virginia Republican Governor Robert McDonnell, who was prosecuted by now-Special Counsel Jack Smith for violating federal bribery law, spoke out about Smith's approach to cases.

McDonnell's conviction was unanimously overturned by the U.S. Supreme Court in 2016. The Supreme Court ruled that the actions McDonnell was accused of, such as setting up a meeting or organizing an event, did not constitute an "official act." Smith, who was in charge of the Public Integrity Section at the Justice Department at the time, has since indicted former President Donald Trump for mishandling classified information.

McDonnell appeared on "Life, Liberty & Levin" to discuss his case and express his opinion on Smith's prosecutorial tactics. He described the three-and-a-half-year ordeal as "exceptionally painful" and maintained his innocence throughout.

McDonnell's attorneys had presented an extensive brief to the Justice Department, arguing that Smith and his prosecutors had misinterpreted the law. Despite this, the indictments were pursued, and McDonnell claimed that leaks to The Washington Post further damaged his reputation.

Although the Supreme Court ultimately vindicated McDonnell, he emphasized the emotional toll the case took on him and his family. McDonnell criticized Smith's handling of other high-profile cases, including the Lois Lerner case, where Smith allegedly advised targeting conservatives, and the case against Democratic Senator Bob Menendez, which ended in a mistrial. McDonnell accused Smith of being overzealous and prioritizing winning over ensuring the facts align with the law.

Host Mark Levin pointed out that Smith's track record includes a mistrial in the campaign-finance-related prosecution of former Democratic presidential candidate John Edwards. The New York Times also highlighted several unsuccessful or unfiled charges under Smith's DOJ section, involving figures such as former Republican Senator John Ensign, former House Majority Leader Tom DeLay, the late Republican Representative Don Young, and former Democratic Representative Allan Mollohan.

Smith, who was appointed as special counsel by Attorney General Merrick Garland in November 2022, pledged to conduct independent investigations and prosecutions in line with the Department of Justice's principles. He assured that the pace of the investigations would not slow down under his watch and that he would exercise independent judgment based on the facts and the law.
