A former supervisory agent of the FBI was allegedly spooked by the agency into withholding information from Congress regarding an alleged cover-up in the criminal investigation of Hunter Biden, according to IRS whistleblower Gary Shapley.

The retired agent received a warning letter from FBI general counsel Jason Jones just before his deposition before the House Oversight Committee, advising him not to disclose any details about ongoing investigative activities.

Shapley claims that the agent could have confirmed additional material facts about the investigation but was only able to speak about the FBI's notification of the transition team and Secret Service regarding a planned interview with Hunter Biden in December 2020. The Oversight Committee has not yet released the transcript of the former agent's interview.

The retired agent had traveled to Hunter Biden's residence in California as part of a plan to interview him about potential tax fraud and other crimes. However, the plan fell apart when federal prosecutors alerted the Biden transition team and the Secret Service, leading Hunter's lawyers to block the attempt.

An aide from the Oversight Committee believes that the Biden administration and President Biden's son's attorneys have been trying to obstruct transparency into the elder Biden's alleged involvement in his son's foreign dealings and the purported cover-up in the Hunter Biden criminal investigation.

The committee spokesperson questioned why witnesses who appear before the committee are being intimidated by the Justice Department, Hunter Biden's attorneys, and their Democratic defenders in Congress if there is nothing to investigate.

The FBI denied that the letter sent to the former supervisory agent was meant to intimidate a congressional witness, stating that such authorization letters are standard practice. Both the FBI and the Delaware U.S. attorney's office have argued that full transparency with Congress is not possible due to an ongoing investigation involving the Bidens. This claim was made even after Hunter agreed to a probation-only plea deal, which was rejected by a federal judge last week.

While federal prosecutors stated in court that they retained the right to prosecute Hunter for other past crimes, Hunter's legal team insisted that his legal exposure would end with the plea deal. A leaked document also indicated that prosecutors had secretly agreed to grant broad immunity for past conduct.

Shapley, who led the IRS's investigation of Hunter for over three years, testified alongside IRS agent Joseph Ziegler at a public House Oversight Committee hearing last month. Both Shapley and Ziegler claimed that standard investigative steps were blocked and that they were discouraged from analyzing Joe Biden's role in his son's enterprises, despite clear communications implicating him.

One such message was a threatening WhatsApp message from Hunter to a Chinese-government-linked associate in July 2017, in which he mentioned being with his father and expecting a business agreement to be fulfilled before the transfer of approximately $5 million to Biden-linked accounts.

Shapley, a registered Republican who has voted for Democrats in the past, and Ziegler, a Democrat who faced online smears for being gay, have provided the House Ways and Means Committee with names of individuals who they believe have information that can shed light on the situation. The House Judiciary Committee has also demanded testimony from 11 FBI and Justice Department figures, including Delaware U.S. Attorney David Weiss, regarding the alleged cover-up in the Hunter Biden case.

The committee hopes to interview Weiss last after the other witnesses have commented on Shapley and Ziegler's claim that Weiss was prevented from bringing felony charges against Hunter Biden by his father's appointed U.S. attorneys in Los Angeles and Washington, DC. This would directly contradict Attorney General Merrick Garland's testimony under oath.

There is already some corroboration of the IRS whistleblowers' claims. For example, after Shapley detailed Weiss' alleged statement at a meeting in October 2022 that he was not the final decision-maker on charging the President's son, IRS Special Agent in Charge Darrell Waldon replied in an email that Shapley had "covered it all." The Justice Department has offered to allow Weiss to testify but has not agreed to permit the other 10 officials to answer questions. As a result, the Judiciary Committee may issue subpoenas to compel their testimony.

Shapley pointed out that Hunter Biden received preferential treatment in his plea deal compared to similar cases. He cited the case of former Baltimore Police Commissioner Darryl De Sousa, who pleaded guilty in 2018 to three tax misdemeanors and received 10 months in prison for evading less than $68,000 in taxes. In contrast, Hunter evaded hundreds of thousands of dollars in tax payments in 2017 and 2018. Shapley argued that this discrepancy is evidence that taxpayers are not being treated fairly.
