The conservative watchdog group, Judicial Watch, in conjunction with the Daily Caller News Foundation, has appealed to the Delaware Supreme Court to reopen their case demanding the release of President Biden's Senate records.

This move comes in the wake of revelations by Special Counsel Robert Hur that the University of Delaware may have misled the courts.

The University of Delaware has consistently refused to release Biden's records, stating that they will remain sealed until two years after Biden's retirement from public life. "The collection of former Vice President Biden's senatorial papers is still being processed, with many items yet to be cataloged," a school spokeswoman explained via email. "The entire collection will remain closed to the public until two years after Mr. Biden retires from public life."

In 2020, Judicial Watch and the Daily Caller News Foundation filed a Freedom of Information Act (FOIA) lawsuit seeking access to all of Biden's Senate records, which comprise 1,850 boxes. However, the Delaware Supreme Court sided with the University of Delaware last year, blocking the release of these records, as reported by the Daily Caller News Foundation.

Tom Fitton, the President of Judicial Watch, has called for Congress to intervene. "The public has a significant interest in these documents," Fitton told the DCNF. "If the Delaware courts are going to protect Biden from having to produce them or the secret deal that keeps them away from the American people, then Congress should get involved."

The reluctance to unseal Biden's Senate records has led to speculation that they may contain evidence of a sexual assault complaint filed by Tara Reade in 1993. Reade, who has accused Biden of sexual assault, has repeatedly urged the release of these records, which are currently inaccessible to the public and stored at the University of Delaware.

Last month, Special Counsel Robert Hur released a 345-page report on the scandal surrounding Biden's stolen classified documents. The report, reviewed by this reporter, revealed that Biden's classified documents were discovered at the University of Delaware and that taxpayer money was used to process his senatorial records.

"In January, February, and June 2023, FBI agents identified and recovered just over a dozen marked classified documents in Mr. Biden's Senate-era papers housed at the University of Delaware. Almost all of these documents predate the Senate's establishment of rules for the tracking and handling of classified information," Hur wrote in his report.

Hur's findings contradict the University of Delaware's sworn statements that no taxpayer money was used to process the records. As a result, Judicial Watch is now pushing to compel the University of Delaware to release Biden's Senate records.

The filing by Judicial Watch states that the Special Counsel Report found that Biden had directed two of his former Senate staffers to review his boxes in storage, and that these staffers were paid by the University of Delaware to perform the review. The filing argues that these payments constitute consideration paid on Biden's behalf in connection with the donation of his senatorial papers to the University, contrary to the University's representations.

Michael Bastasch, editor-in-chief for the Daily Caller News Foundation, stated, "The stunning revelations from the Hur report extend beyond the president's memory lapses and mental state. The court needs to reopen this case to determine whether the University of Delaware lied."

"The Hur report provides disturbing evidence the University of Delaware misled the courts in order to hide Biden's Senate papers," Judicial Watch President Tom Fitton added.
