According to The Post Millennial, Los Angeles County District Attorney Nathan Hochman announced that capital punishment would not be pursued against Nick Reiner, despite the gravity of the allegations and the double-murder charges now pending against him. “In deciding whether or not the DA's office was going to seek the death penalty, we have gone through a rigorous review where we look at the aggravating factors, as well as the mitigating factors – where we have spoken to the victims' family, we have spoken to prosecutors, law enforcement, and I've worked with the most senior people in the district attorney's office," Hochman said.
The decision reflects the increasingly common trend in deep-blue jurisdictions to move away from the harshest penalties, even in cases involving particularly violent crimes.

“After a careful and thorough review of all these factors, the district attorney’s office will not be seeking the death penalty in this case,” Hochman told reporters on Tuesday. “That means that the maximum sentence that Mr. Reiner will be looking at is life without the possibility of parole.” While life without parole is severe, many Americans who support strong law-and-order policies may question why a double homicide, allegedly committed against one’s own parents, does not qualify for the ultimate punishment.

The district attorney declined to specify what punishment the extended family is seeking, but he emphasized that both Rob and Michele Reiner were personally opposed to capital punishment. “We did speak with Nick Reiner’s siblings (and) they made their views very clear,” Hochman added. “We took their views into consideration in ultimately deciding not to seek the death penalty.”

Nick Reiner’s siblings have also requested that the grand jury transcripts remain sealed from public view. “They basically have said that the disclosure to the public and the media of the details and evidence of the killing of their parents will cause them additional trauma and harm, and they have respectively asked for the court to keep the transcript sealed,” Hochman said.

Reiner has pleaded not guilty to the killings, setting the stage for a high-profile trial that will test both the evidence and the DA’s judgment in rejecting the death penalty. As the case proceeds, many will watch whether a system that often goes soft on violent offenders will deliver the full measure of justice available under the law, short of capital punishment.
