This move comes in response to the board's refusal to grant ballot access to three political parties, despite each party having surpassed the required number of signatures for qualification.
According to The New York Post, the Judiciary Committee, in conjunction with the House Administration Committee, has expressed concerns over the board's decision, seeking further "documents and information" to understand the rationale behind it. The committees are particularly interested in whether the decision was politically motivated and aimed at influencing the 2024 presidential election by restricting the pool of candidates.
"The Committee on House Administration and the Committee on the Judiciary are concerned that the NCSBE’s decision was politically motivated and may have been done to influence the 2024 presidential election by limiting the candidates for which voters may cast their ballots,” wrote Jordan and Rep. Bryan Steil, R-Wisconsin, who chairs the House Administration Committee.

The three parties in question, which support Robert F. Kennedy Jr., Cornel West, and Randall Terry for the 2024 presidential race, had each submitted more than the 13,865 votes required to appear on the ballot, as per records from the state’s Board of Elections. Despite initially being denied ballot access, the committee has indicated that they will revisit the issue in July.

The federal committees' letter suggests that the decision was influenced by the "political motivations" of the board members. It highlights that all three Democrat members of the board voted against the petition requests. “For example,” the letter says. “In its denial of one petition, the Democrat members voted to block the petition simply because the address of the party’s chairman was not up to date on the petition sheets.” In contrast, both Republican members voted in favor of approving the petition.

The board's decision has been met with widespread criticism. The Libertarian Party of North Carolina, for instance, issued a statement in support of the petitions from the other three parties, denouncing the decision as "election interference."

The federal committees have requested a swift response from the board, as any further delay could result in the candidates missing the November ballot deadline. The committees aim to "conduct oversight" and prevent any undue "influence" or "sway" the board may be attempting to exert over the North Carolina election.
